1. Introduction

Welcome to apmc2025.com (the “Site”). This Site is owned and operated by the Ceylon Motorsports Club (CMSC), located in Sri Lanka (“CMSC,” “we,” “us,” or “our”), to provide information and facilitate registration for the Asia Pacific Motorsport Championship 2025 (the “Event”).

These Terms and Conditions (“Terms”) govern your access to and use of the Site and its content, features, and services (collectively, the “Services”). By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, please do not use the Site.  

2. Use of the Site

• Permitted Use: You may use the Site for informational purposes related to the Event and for registering for the Event, in accordance with these Terms.
• Prohibited Use: You agree not to:
  
  • Use the Site for any illegal or unauthorized purpose.
  • Interfere with or disrupt the operation of the Site or the servers or networks connected to the Site.  
  • Attempt to gain unauthorized access to any portion of the Site or any systems or networks connected to the Site.  
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site, use of the Site, or access to the Site without express written permission from us.  
  • Use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission.
  • Transmit any worms, viruses, or any code of a destructive nature.
  • Post or transmit any material that is defamatory, obscene, fraudulent, harmful, or otherwise objectionable.

3. Event Registration

• Registration Process: To participate in the Event, you must complete the official registration process available on the Site. This will involve providing personal information as detailed in our Privacy Policy.
• Accuracy of Information: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.  
• Registration Fees: Applicable registration fees for the Event will be detailed on the Site. Payments are processed through our third-party payment gateway, Payhere.lk. By providing payment information, you represent and warrant that you are authorized to use the payment method and authorize Payhere.lk to charge your payment method for the total amount of your registration, including any applicable taxes and fees.  
• Confirmation: Event registration is subject to confirmation by CMSC. We reserve the right to refuse or cancel any registration at our sole discretion, for reasons including but not limited to non-payment, provision of false information, or violation of these Terms or event-specific regulations.
• Cancellations and Refunds: Policies regarding event registration cancellations and refunds, if any, will be separately communicated or made available on the Site or during the registration process.

4. Intellectual Property Rights

• Ownership: All content on the Site, including but not limited to text, graphics, logos, images, audio clips, video clips, data compilations, and software, and the compilation thereof (collectively, the “Content”) is the property of CMSC, its affiliates, partners, or licensors, and is protected by Sri Lankan and international copyright laws and other intellectual property laws. The trademarks, logos, and service marks displayed on the Site (collectively, the “Trademarks”) are the registered and unregistered marks of CMSC, its affiliates, licensors, or partners, in Sri Lanka and other countries, and are protected by Sri Lankan and international trademark laws.  
• Limited License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and make personal, non-commercial use of the Site and the Content. This license does not include any resale or commercial use of the Site or its Content; any collection and use of any event listings, descriptions, or prices; any derivative use of the Site or its Content; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.  
• Restrictions: You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as generally permitted through the Site’s functionality for your personal, non-commercial use.

The Site may contain links to other websites or resources provided by third parties (e.g., Payhere.lk, social media platforms, accommodation partners). These links are provided for your convenience only. We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them. If you decide to access any of the third-party websites linked to this Site, you do so entirely at your own risk and subject to the terms and conditions of use for such websites.

6. Disclaimer of Warranties

THE SITE AND ITS CONTENT AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER CMSC NOR ANY PERSON ASSOCIATED WITH CMSC MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE.  

WITHOUT LIMITING THE FOREGOING, NEITHER CMSC NOR ANYONE ASSOCIATED WITH CMSC REPRESENTS OR WARRANTS THAT THE SITE, ITS CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SITE OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.  

TO THE FULLEST EXTENT PROVIDED BY LAW, CMSC HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.  

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

7. Limitation of Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL CMSC, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.  

THIS LIMITATION OF LIABILITY DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.  

LIABILITY RELATED TO PARTICIPATION IN THE ACTUAL MOTORSPORT EVENT ITSELF WILL BE GOVERNED BY SEPARATE AGREEMENTS, WAIVERS, AND EVENT-SPECIFIC REGULATIONS WHICH PARTICIPANTS WILL BE REQUIRED TO AGREE TO.

8. Indemnification

You agree to defend, indemnify, and hold harmless CMSC, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, any use of the Site’s content, services, and products other than as expressly authorized in these Terms or your use of any information obtained from the Site.  

9. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of, or related to, them, their subject matter, or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the internal laws of Sri Lanka without giving effect to any choice or conflict of law provision or rule.  

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the courts of Sri Lanka. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.  

10. Changes to Terms and Conditions  

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.  

By continuing to access or use our Site after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the Site. It is your responsibility to check this page periodically for changes.  

11. Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

12. Waiver

No waiver by CMSC of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of CMSC to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

13. Entire Agreement

These Terms and our Privacy Policy constitute the sole and entire agreement between you and the Ceylon Motorsports Club regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site. Specific terms and conditions related to event participation, safety, and regulations will be provided separately to registered participants.
